Terms of Service

1. Service Description

NetSkill Leads ("Service"), operated by NetSkill Ventures LLC ("Company," "we," "us," or "our"), is an AI-powered property inquiry response platform for licensed real estate professionals. The Service automatically responds to incoming real estate inquiries via SMS text messages, conducts AI-driven conversations through subscribing agent accounts, and facilitates appointment scheduling through calendar integrations.

Our Service uses artificial intelligence, powered by Anthropic's Claude, to generate and send text messages through subscriber accounts. These messages are automated and generated in real time based on property inquiries, property details, and agent preferences. By subscribing, you authorize us to send automated text messages from a dedicated phone number assigned to your account.

2. SMS Messaging Terms

When consumers submit a property inquiry on a real estate agent's website and provide their phone number, they may receive a single introductory text message from the agent's authorized messaging service asking if they would like to continue the conversation via text. The consumer must reply YES to opt in to further text messages. No additional messages are sent without the consumer's affirmative reply.

By replying YES, the consumer agrees to receive text messages from the listing agent and their authorized service providers regarding their property inquiry. Messaging consent is not a condition of purchasing any property or service. Consent to receive text messages is voluntary and is not required as a condition of purchasing, selling, or viewing any property.

Program Description: NetSkill Ventures sends text messages through licensed real estate agent accounts to consumers who have opted in to receive texts regarding their property inquiries. Messages may include property details, answers to questions about listings, and appointment scheduling.

Message Frequency: Message frequency varies. Typically 1-10 messages per conversation.

Message and Data Rates: Message and data rates may apply. Contact your wireless carrier for details.

Opt-Out: Text STOP to any message to opt out. You will receive a confirmation message and no further messages will be sent.

Help: Text HELP to any message for assistance. You will receive support contact information.

Carrier Liability: Carriers are not liable for delayed or undelivered messages.

Privacy: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes at any time. All categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

3. Subscription Terms

The Service is offered on a month-to-month subscription basis with the following pricing:

  • Solo Agent: $197 per month
  • Brokerage Pricing: Volume discounts available for teams of 3 or more agents

All fees are billed in U.S. dollars through Stripe. Your subscription renews automatically each month on the anniversary of your start date. You may cancel at any time from your dashboard without penalty.

Founding Member Rate Lock: Subscribers who purchased a founding seat (the first 25 accounts) are grandfathered at $197/month for the lifetime of their active subscription. This rate will not increase as long as the subscription remains active and in good standing. This guarantee is contractual and is not subject to future price changes announced under Section 12 of these Terms.

4. 60-Day Lead Response Guarantee

If NetSkill fails to respond to any lead within 60 seconds during your first 60 days of active service, you are entitled to a full refund of subscription fees paid. To claim, email jackson@netskillleads.com with “refund” in the subject line. No forms, no negotiation, no questions asked. Refund is processed within 5 business days via the original payment method.

5. SMS Messaging Terms (Agents)

By using the Service, you acknowledge and agree to the following SMS terms:

  • Automated text messages are sent on your behalf to consumers who have provided their phone number and consented to receiving communications.
  • Message frequency varies based on consumer engagement and conversation activity.
  • Standard message and data rates may apply to recipients.
  • Consumers may reply STOP at any time to unsubscribe from further messages. The system immediately ceases all communication upon receiving an opt-out request.
  • No text messages are sent during quiet hours (9 PM to 8 AM in the consumer's local timezone) in compliance with TCPA regulations.

You are responsible for ensuring that consumers whose information you submit to the Service have provided appropriate consent to receive automated text messages. You must not submit phone numbers of individuals who have not opted in to receive such communications.

6. AI Disclosure

All text messages sent through the Service are generated by artificial intelligence. The AI assistant identifies itself as an assistant (not a human) in its initial communication with each consumer. You agree not to instruct the AI to misrepresent itself as a human or to remove AI disclosure from conversations.

The AI is designed to answer property-related questions, qualify consumers, and schedule appointments. It will not provide legal advice, financial advice, or make guarantees about property values, conditions, or availability.

7. Acceptable Use

You agree to use the Service only for legitimate real estate business purposes. You may not:

  • Submit phone numbers of individuals who have not consented to receive automated messages
  • Use the Service to send spam, unsolicited messages, or marketing unrelated to real estate
  • Attempt to circumvent opt-out or quiet hours protections
  • Misrepresent the nature of the AI-generated messages to consumers
  • Use the Service in violation of any applicable federal, state, or local laws, including but not limited to the Telephone Consumer Protection Act (TCPA)
  • Share your account credentials or allow unauthorized access to your account
  • Interfere with or disrupt the Service or its infrastructure

Violation of this acceptable use policy may result in immediate suspension or termination of your account without refund.

8. Data Ownership

You retain full ownership of your contact data, including contact information, conversation transcripts, appointment records, and any other data generated through your use of the Service. We process your data solely to provide the Service and do not claim any ownership rights over your data.

You grant us a limited, non-exclusive license to process, store, and transmit your data as necessary to operate the Service on your behalf. This license terminates upon deletion of your data following account cancellation.

9. No Guarantee of Results

The Service is designed to improve inquiry response times and engagement. However, we make no guarantees regarding the number of appointments booked or properties sold as a result of using the Service. Results vary based on market conditions, inquiry quality, agent responsiveness, and other factors outside our control.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by applicable law, NetSkill Ventures LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of the Service.

Our total aggregate liability for any claims arising out of or related to the Service shall not exceed the total amount you paid to us in the twelve (12) months preceding the claim.

11. Termination and Cancellation

You may cancel your subscription at any time from your dashboard. Upon cancellation:

  • Your account remains accessible in read-only mode for 30 days following cancellation.
  • All AI-powered messaging ceases immediately upon cancellation.
  • Your contact data, conversation transcripts, and account data are available for export during the 30-day post-cancellation period.
  • After 30 days, your data is permanently deleted upon request. If no deletion request is made, data may be retained in anonymized form for aggregate analytics.
  • Your dedicated SMS number is released and cannot be guaranteed for reassignment if you resubscribe.

We reserve the right to suspend or terminate your account at any time for violation of these Terms, with or without notice.

12. Modifications to Terms

We may update these Terms from time to time. Material changes will be communicated via email to the address associated with your account at least 14 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Virginia.
